Send it back, but the seller needs to pay you for shipping. If he pays for shipping, send it back,if he declines to pay for shipping, keep it. Case closed... It's the right thing to do regardless what the seller did or did not do. Only my opinion however
Keep it. The seller had to know SS was putting these into general circulation and knew he couldn't make his money on an obvious flip and put you in a position to start a claim. He played the odds that he would win and he lost. You paid for the item as a responsible eBay buyer, and only wanted to return it because you felt screwed on the price - buyers regret. There's nothing wrong with that and he didn't lose anything financially either. So he can't flip it again at a later date, but that's not your problem.
my dad was a firm believer that we reap what we sow. he would have deduced that the guy got his payment, and being that i was refused a return as stated in the seller's terms, that i should keep the figure.
now the additional question is, should i leave the seller positive, neutral, negative or no feedback for the ebay transaction? i personally think he deserves a negative for his refusal to issue a refund even though his terms clearly said 14 day money back guarantee if not satisfied.
I say neutral. Your on a good path, with good karma being returned. Yes he didnt do what was said but you got the toy, money. So nothing really went bad , a bit of frustration with the phone call but you got a lot for it.

I would leave him negative feedback. He sounds like a smug. He didn't treat you right and he probably wont treat other people right either, so let us know he's a dirtback and give him what he ASKED for :-)
